Who Can be a Witness at Nikah?

Question

I would like to confirm who is allowed to be a witness to Nikah.  Everyone I know seems to have a different opinion on what is required.  My situation is this – I am to be married to a Muslim man and my parents and other family members are unable to attend the wedding due to being in a different country.  My husband to be is in the same situation.  I do have a sister and brother who live in the same city as me – so can I use them to be my witness?  Also is it necessary to have an elder preside at the wedding?  How many witnesses are required from each side?  If you could describe the Nikah process fully so that I am able to prepare, I will greatly appreciate it.

Answer

The number and nature of witnesses required in a Nikah is not prescribed by the Shari`ah. The issue relates to the legislation of the country that one is living in. Thus, subject to the legislation of the country, anyone can be made a witness on the Nikah contract.
