Inheritance of Property

Question

Assalam-u-alikum,

A person died, leaving behind a wife and a daughter (married). He also have 4 brother who are married. How will be the property will be divided. I read from different places, half of the property will belong to daughter, 1/8 to the wife and remaining will be distributed to closed male relation of the person who died. Know in this case will the remaining property will be divided equally to the 4 brothers of the died person.

Answer

The inheritance in the said case will be divided as follows: 1/8th to the wife; 1/2 of the balance (7/8) (i.e., 7/16th) to the daughter; the balance (i.e. 7/16th) to be divided according to the will of the deceased, if any. In the absence of any will, it may be given to the closest male relative of the deceased. In the given case, as you have mentioned, the balance will be divided equally among the four brothers of the deceased.
